Despite Tornado Cash being a non-custodial platform that never holds user funds, the court argued that Pertsev and his co-founders failed to implement adequate measures to prevent misuse of the platform by bad actors. Pertsev’s defense hinged on the claim that he could not be held accountable for the actions of users misusing Tornado Cash. However, this argument was rejected in his March 2024 trial. Pertsev is currently serving a five-year, four-month sentence, underscoring the ongoing scrutiny faced by developers of privacy-focused blockchain technologies.
